Reseller Terms of ServiceAs a Reseller, you agree to the following conditions:I agree that I am financially responsible for the fees related to my resold virtual hosting accounts, and understand that I'm free to charge my customers whatever I choose. I will handle all support and billing duties related to my accounts, and in no event will my customers be given direct access to DrakNet, the DrakNet support email addresses, the DrakNet toll free support line, nor will my clients contact DrakNet in any other manner. Likewise, under no circumstances will DrakNet directly handle my clients inquiries or contact my clients in any way. Should clients contact DrakNet, they will be referred to the Reseller. Should I refer my clients to DrakNet or refuse to support my clients or abandon my reseller account, the Reseller contract will be considered void and DrakNet will take whatever steps deemed necessary to aid my clients without contractual restriction of the reseller agreement, up to and including taking over the management of their accounts should those clients contact DrakNet. DrakNet will at no time instigate that contact regardless of the termination of the Reseller Agreement. I understand that reseller support inquiries are to be initiated via email to support@drak.net, or via the chat interface. DrakNet will make a diligent effort to resolve any problem related to hardware or supporting software. Only after all email inquiries have failed will DrakNet provide support via telephone. I agree to take full responsibility for all taxes and fees of any nature associated with products and services sold from my accounts. DrakNet shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from my or my customer's use of server. I agree to indemnify and hold harmless DrakNet from and against any and all claims, actions, causes of actions, losses or damages (including legal fees) arising from my or my customer's usage of the service in violation of these terms of service. I agree that I will monitor my accounts and client sites once per week to ensure that all clients are operating within the parameters outlined in the shared hosting TOS by logging in to the WHM, and that should I cease monitoring my client sites for 1 full month, my account may be considered abandoned, and terminated. I agree that in the event that DrakNet may at any time believe that the service is being utilized by me or my customers in violation with the terms of service, DrakNet may immediately discontinue such service without liability or refund of unearned prepaid service fees. I acknowledge that DrakNet makes absolutely no warranties whatsoever, express or implied with respect to the service to be provided. As a result, I agree that DrakNet shall not be liable for any claims or damages which may be suffered me or my customers, including, but not limited to, losses or damages resulting from the loss of data as the result of delays, non deliveries, or service interruptions caused by the fault or negligence of DrakNet. I acknowledge that I must keep a credit card on file at all times.
